POWER OF ATTORNEY

I, [full name of citizen A.] (born "__" _____________ ___ year; on the date of issuance of the power of attorney - passport _____, issued by ___________________________________ "__" ____________ ___ year; taxpayer registration number (RNOKPP) - ___), residing in Kyiv [address], fully aware of the significance of my actions and acting voluntarily, in accordance with Articles 244-250 of the Civil Code of Ukraine, hereby authorise [full name of citizen B.], who lives in Kyiv [address], to represent my interests in relation to the sale of the real estate owned by me, including a share in apartment No. __, located in building No. __, on Yevhen Konovalets Street in Kyiv, and to perform all actions necessary for the conclusion, notarisation and state registration of the sale and purchase agreement.
For this purpose, the attorney is entitled to:
- represent my interests before a notary, a centre for administrative services (CNAP), the state registrar of rights to immovable property and their encumbrances, the BTI or any other technical inventory provider, local self-government bodies, tax authorities, residence registration authorities, OSBB, the managing company, housing maintenance organisations, banks, utility providers and any other institutions or organisations if needed to perform this power of attorney;
- submit, sign and receive applications, requests, certificates, extracts, information certificates, a technical passport, technical documentation, BTI documents, acts, receipts, preliminary agreements, the sale and purchase agreement, the handover and acceptance act, applications for state registration of rights and any other documents needed for the sale and registration of the buyer's ownership;
- obtain an extract from the State Register of Rights to Immovable Property, information on registered encumbrances, prohibitions or mortgages, and any other documents needed for the sale;
- obtain spousal consent, co-owner consent and other documents if they are required by law, and, in the case of a sale of a share in common fractional ownership, notify the co-owners, receive their replies and arrange a waiver of the pre-emptive right to buy if needed;
- sign for me, including applications, requests, the sale and purchase agreement, the handover and acceptance act, applications for residence deregistration or registration and any other supporting documents;
- agree with the other party on the price, timing, settlement procedure and other contract terms, and receive the money due to me from the buyer, including advance payments, deposits or other payments;
- open, use and close a bank account if it is needed for cashless settlement under the sale and purchase agreement, submit applications, forms, signature cards, and receive statements, receipts and other banking documents;
- pay notarial, registration, technical, valuation, banking, tax and other mandatory charges, if they arise under the law;
- submit applications for residence deregistration in the sold property, if this is needed for the performance of the contract;
- challenge refusals, actions or omissions of officials and perform any other acts necessary for the full performance of this power of attorney.
This power of attorney is issued with the right to delegate powers to third parties and shall remain in force until "___" ____________ 20__ unless terminated earlier in accordance with the requirements of civil law, of which I shall notify the representative in writing.
The content of Articles 244-250 of the Civil Code of Ukraine, Articles 60-74 of the Family Code of Ukraine regarding joint marital property, and the provisions of the Tax Code of Ukraine regarding taxation of income from the sale of immovable property have been explained to me by a notary.
