POWER OF ATTORNEY
City of Kyiv, this twenty-third day of August, two thousand twenty-four
I, [full name of citizen A.], holder of passport series ____ No. _____________, issued by _______________________________ “____” _____________ _____ year, born on “___” ___________ ______ year, taxpayer registration number ____________, residing in Kyiv [address],
being aware of the general requirements, compliance with which is necessary for the validity of this transaction, and understanding the meaning of my actions, acting voluntarily and guided by Articles 244-250 of the Civil Code of Ukraine, by this power of attorney I hereby authorize [full name of citizen B.], who lives in Stryi, Lviv region [address],
with authority to sell my privately owned apartment No. __ in building No. __ on Valova Street in Kyiv.
For this purpose, [full name of citizen B.] is entitled to:
- represent my interests in this connection in any enterprises, institutions and organisations regardless of organisational form and subordination concerning the ordering and receipt of documents necessary for me, including the relevant district state administration, executive bodies, notary bodies, administrative service centres (CNAP), bureaus of technical inventory (BTI), state registrars of rights to immovable property, housing-maintenance bodies and organisations, utility service providers, any other organisations and institutions of the city of Lviv, including gas, electricity, heat and water supply and communications bodies, internal affairs bodies and other enterprises, institutions and organisations not specified in this power of attorney, to the extent their consideration falls within the competence of the said bodies;
- order and receive documents that, in accordance with the requirements of applicable law, are necessary to conclude the apartment sale agreement, certificates of registration of residence of persons in the said apartment, extracts from the State Register of Rights to Immovable Property, documents and certificates concerning the absence of joint common ownership or marital status, and other documents necessary for the sale;
- submit on my behalf any statements related to the performance of this power of attorney and provided for by applicable law, in particular notarial law;
- submit any other documents necessary to resolve the matters covered by this power of attorney;
- enter into a preliminary apartment sale agreement on terms at their own discretion, with the right to make advance or any other payments;
- enter into the apartment sale agreement and, in doing so, determine the price, possible deadlines and other terms of the agreement at their own discretion;
- sign for me on applications, agreements, other documents and on their receipt;
- pay for services rendered, works performed, and other payments due from me, including those provided for by the terms of the civil-law contracts to be concluded;
- receive the money due to me under the preliminary agreement and under the apartment sale agreement;
- submit documents for state registration of the transfer of title to the apartment to the relevant bodies carrying out state registration of rights, and perform all other legally significant actions provided for by applicable law for this type of authority, which I would have to perform in person and which will be necessary and appropriate for the full performance of the powers of attorney.
The power of attorney is issued without the right to delegate powers to other persons and is valid until the twenty-third day of August, two thousand thirty, unless revoked by me earlier, of which I shall notify the representative in writing.
The content of Articles 240-245, 247-250 of the Civil Code of Ukraine regarding the concept of a power of attorney, its form, terms, delegation and termination of representation by power of attorney, revocation of a power of attorney and refusal of a representative to perform actions for which it was issued has been explained to me by a notary.
