POWER OF ATTORNEY
City of Kyiv, twenty-sixth day of December, two thousand twenty-four
I, [full name of citizen A.], holder of passport series ____ No. _____________, issued by _______________________________ “____” _____________ _____ year, born on “___” ___________ ______ year, taxpayer registration number ____________, residing in Kyiv [address],
acting voluntarily and guided by Articles 244-250 of the Civil Code of Ukraine, by this power of attorney I hereby authorise [full name of citizen B.], who lives in Kyiv [address],
to sell on my behalf the share in apartment No. __ in building No. __ on Pugacheva Street in Kyiv that belongs to me on the right of private ownership.
For this purpose, [full name of citizen B.] is entitled to:
- represent my interests before any enterprises, institutions and organisations regardless of form of ownership or subordination, including notaries, administrative service centres (CNAP), bureaus of technical inventory (BTI), state registrars of rights to immovable property, place-of-residence registration authorities, condominium associations (OSBB), building managers, housing and utility providers, communications bodies, internal affairs authorities, and any other institutions needed to complete the sale;
- order and receive documents, certificates, extracts and records needed for the sale of the apartment share and for state registration of the transfer of ownership, including extracts from the State Register of Real Rights to Immovable Property, BTI documents, the technical passport, certificates about persons registered in the apartment, documents concerning marital status and the existence or absence of spouses' joint common ownership, and other documents that the notary or state registrar may require;
- notify co-owners of the intention to sell the share, submit and receive notices, waivers of the pre-emptive right of purchase, and other documents related to the pre-emptive right to buy the apartment share;
- submit statements on my behalf, sign documents, agreements and acts required to perform this power of attorney, and receive them;
- enter into a preliminary sale agreement for the apartment share on terms at their own discretion, with the right to receive an advance payment or any other payment;
- enter into the sale and purchase agreement for the apartment share, determine the price, timing and other material terms of the agreement at their own discretion;
- sign statements, agreements, other documents and handover acts on my behalf and sign for their receipt;
- pay on my behalf any payments related to the preparation and sale of the apartment share, including notarial, administrative, registration, tax and other mandatory payments if due;
- receive the funds due to me under the preliminary agreement and the sale and purchase agreement;
- submit documents for state registration of the transfer of ownership to the apartment share and perform all other legally significant actions needed for the full exercise of the powers granted hereunder, which I would otherwise have to perform personally and which do not conflict with the law.
This power of attorney is issued with the right to delegate powers to other persons and is valid until the twenty-sixth day of December, two thousand twenty-seven, unless revoked by me earlier, of which I shall notify the representative in writing.
The notary has explained to me the content of Articles 240-245, 247-250 of the Civil Code of Ukraine concerning the concept of a power of attorney, its form, term, delegation and termination of representation by power of attorney, revocation of a power of attorney and the refusal of a representative to perform the acts for which it was issued.
