Power of attorney to sign a gift agreement for a residential house and land plot and state registration of ownership

I, [full name of citizen A.], passport _________, issued by ______________________ on "__" __________ ___, taxpayer registration number __________, residing at [address], hereby authorise [full name of citizen B.], passport _________, residing at [address], to represent my interests in connection with the notarisation of a gift agreement and the state registration of ownership of:

1. a residential house with outbuildings and structures at the address: Irpin [address], which belongs to me on the basis of a Certificate of Ownership issued by the Executive Committee of the Irpin City Council on "__" __________ ___, pursuant to decision No. __ dated "__" __________ ____;
2. a land plot of 0.16 hectares within the boundaries according to the plan at the same address, which belongs to me on the basis of a state act on the right of private ownership of land issued by the Irpin City Council of Kyiv Region on "__" __________ ____.

For this purpose, [full name of citizen B.] is authorised to:

• file on my behalf applications, petitions, explanations and other documents required for notarisation of the gift agreement, state registration of the transfer of title and performance of this power of attorney;
• submit documents confirming that the property is not part of the spouses' joint property, as well as documents on marital status and family ties with the donee, if needed for notarisation and tax purposes;
• obtain extracts from the State Register of Property Rights to Immovable Property, the State Land Cadastre, the Unified Register of Prohibitions on Alienation of Immovable Property, certificates, decisions, notices, refusals, acts, technical documentation, land valuation documents and other documents needed for the gift;
• sign the gift agreement, addenda, applications, handover acts and other documents related to the execution and state registration of the agreement;
• contact notaries, state registrars of rights to real estate, state land cadastre registrars, administrative service centres (CNAP), local self-government bodies, tax authorities, banks and other institutions if needed for the gift formalities;
• receive documents issued in my name, including registry extracts, a copy of the gift agreement and other documents related to this power of attorney;
• pay notarial fees, administrative fees, state duty, taxes, charges and other payments if they are payable;
• perform any other acts necessary for the proper execution of the gift of the residential house and land plot and the state registration of ownership in favour of the donee.

This power of attorney remains valid if the representative's or the donee's address or passport details change, and also if additional proof of family relationship with the donee is required for notarisation. It is issued without the right of substitution and remains valid until "___" __________ 20__ unless terminated earlier in accordance with law.

The meaning of Articles 244-250 of the Civil Code of Ukraine and Articles 60-74 of the Family Code of Ukraine concerning the concept of a power of attorney, its form, term, substitution, termination of representation by power of attorney, revocation of a power of attorney and refusal of the representative to perform the acts specified in the power of attorney has been explained to me by the notary.
