POWER OF ATTORNEY

I, [full name of citizen A.], holder of passport series ____ No. _____________, issued by _______________________________ on "____" _____________ _____, born "____" ___________ _____, taxpayer registration number ____________, residing in Kyiv [address], acting voluntarily and fully aware of the meaning of my actions, on the basis of Articles 244-250 of the Civil Code of Ukraine, hereby authorise [full name of citizen B.], holder of passport series ____ No. _____________, issued by _______________________________ on "____" _____________ _____, taxpayer registration number ____________, residing in Kyiv [address], to represent my interests in relation to the apartment (share in an apartment) owned by me at [address], and in relation to the documents, agreements, payments and settlements connected with it, before any authorities, institutions, organisations, notaries and private individuals.
The representative is entitled, in particular, to:
- use the apartment, have free access to it, and receive keys, passes, certificates, acts, technical and other documentation;
- sell, exchange, lease, pledge or mortgage the apartment, conclude agreements connected with the disposal or use of the apartment, and sign preliminary agreements, main agreements, handover acts, deposit agreements, insurance agreements, repair agreements and other related documents;
- represent my interests in OSBBs, with the building manager, in executive bodies of local councils, at CNAPs, in utility companies, before notaries, state registrars of rights to immovable property and their encumbrances, at BTI or another technical inventory provider, in the State Register of Rights to Immovable Property, in state archival institutions, with residence registration authorities, with utility and telecommunications providers, and in any other bodies or organisations needed for the use, maintenance, disposal or formalisation of rights to the apartment;
- order, submit and receive technical passports, extracts, certificates, opinions, decisions, approvals, notices, acts, copies of title documents, inventory files and any other documents needed for the use of the apartment, repairs, re-planning, re-equipment, place-of-residence registration or state registration of rights, encumbrances or their termination;
- organise, order and supervise repair works, re-planning, re-equipment, reconstruction or other works in the apartment, conclude contracts for the works, sign estimates, requests, acts, reports and other documents necessary for completion of such works;
- submit on my behalf applications, requests, petitions, explanations, declarations and other documents, including in paper or electronic form where permitted by law, sign them and sign all documents executed in connection with this power of attorney;
- conclude, amend and terminate agreements with OSBBs, the building manager, utility companies and service providers, submit meter readings, reconciliation statements, requests for connection or disconnection of services, re-arrange personal accounts, and pay housing and utility charges, contributions and other mandatory payments;
- negotiate and represent my interests in the conclusion and performance of lease agreements, receive rent, deposits, compensation, reimbursements and other payments due to me, deposit them into bank accounts, declare such income and pay taxes, fees and other mandatory payments in accordance with the law;
- open, close and operate bank accounts, including a separate account for rent receipts or other payments, withdraw funds, transfer them, top up accounts, receive statements, certificates and other bank documents, conclude new bank agreements and amend existing ones where needed for apartment management, payment of expenses or receipt of rent;
- represent my interests in courts of Ukraine, before notaries, prosecution authorities, the State Tax Service of Ukraine, the National Police of Ukraine, state enforcement service bodies and a private enforcement officer, where needed to protect my rights, including with all procedural rights provided by law, the right to file claims, applications, motions, evidence, objections and complaints, conclude settlement agreements, withdraw claims, admit claims and receive decisions and enforcement documents;
- receive and hand over postal items, carry out document legalisation or apostille, and receive copies of decisions and other documents needed to perform this power of attorney;
- perform any other actions arising from this power of attorney and required for the proper conduct of my affairs.
This power of attorney is valid only in the territory of Ukraine.
The power of attorney is issued with the right to delegate powers to other persons and shall remain valid until the third day of April, two thousand twenty-seven, unless revoked by me earlier, in which case the representative will be notified in writing.
The power of attorney remains valid if the representative changes the address of residence and/or his or her passport.
The content of Articles 244-250 of the Civil Code of Ukraine, as well as the provisions on the state registration of rights to immovable property, residence registration of persons and the Tax Code of Ukraine, have been explained to me by a notary.
