Power of attorney

I, [full name of citizen A.], passport holder, passport series ____ No. _____________, issued by _______________________________ on "____" _____________ _____ year, taxpayer identification number ____________, residing in Kyiv [address], acting voluntarily and fully aware of the meaning of my actions, pursuant to Articles 244-250 of the Civil Code of Ukraine, hereby authorise [full name of citizen B.], who resides at [address], to represent my interests in relation to the apartment No. __ in building No. __ on John McCain Street in Kyiv that belongs to me by right of ownership, to ensure its proper condition, carry out routine repairs without redevelopment, and rent it out.
For this purpose, the attorney may:
- have free access to the apartment, inspect it, receive and hand over keys, record the condition of the property and prepare inspection reports when needed;
- enter into, amend and terminate lease agreements, preliminary agreements, addenda, handover and return acts, deposit agreements, advance payment agreements and repair contracts connected with the apartment;
- agree on the lease term, rent, payment procedure, security deposit, advance payment, reimbursement of utility costs and other contract terms;
- represent my interests before a notary, a centre for administrative services, the state registrar of rights to immovable property, district state administrations or district military administrations, local self-government bodies, the technical inventory office (BTI), the condominium association (OSBB), the managing company, utility providers, tax authorities and any other institutions if needed for this power of attorney;
- submit, sign and receive applications, explanations, certificates, invoices, receipts, acts, extracts and other documents needed for the use, maintenance and rental of the apartment;
- order and obtain certificates, extracts and other documents related to the apartment, utility services, technical inventory, records and the payment of mandatory charges;
- arrange and sign contracts for routine repairs, order materials, supervise the work and accept its result, provided that such work does not involve redevelopment;
- receive rent, deposit, advance payments, reimbursement of expenses, insurance compensation and other amounts connected with the performance of the apartment-related agreements;
- pay notarial fees, administrative charges, utility bills, taxes and other mandatory payments if such payment is required for the performance of this power of attorney;
- take the matter to court and represent my interests in disputes related to the use, maintenance and return of the apartment if the lease terms are breached;
- perform any other legally significant acts necessary for the proper management of the apartment and its rental, within the limits of the current legislation of Ukraine.
This power of attorney is issued without the right to alienate the apartment specified herein or any other property or property rights belonging to me, and without the right to delegate powers to third parties. It shall be valid until "___" ____________ 20__ unless revoked by me earlier. It remains valid if the representative changes their residential address and/or passport.
The content of Articles 244-250 of the Civil Code of Ukraine, as well as Articles 60-74 of the Family Code of Ukraine concerning the regime of spouses' joint property and the requirements of the Tax Code of Ukraine, has been explained to me by a notary.
