POWER OF ATTORNEY

I, [full name of citizen A.], passport series ____ No. _____________, issued by _______________________________ on "__" ____________ ___, taxpayer identification number ____________, residing at [address], acting voluntarily and fully aware of the meaning of my actions, pursuant to Articles 244-250 of the Civil Code of Ukraine, hereby authorise [full name of citizen B.], who resides at [address], to represent my interests in relation to obtaining a loan, purchasing real estate with loan funds, entering into a mortgage, and preparing all documents needed for the state registration of rights in real estate and, if necessary, for repairs, redevelopment or reconstruction of the acquired property.
For this purpose, the attorney may:
- represent my interests before a bank, a notary, a centre for administrative services (CNAP), the state registrar of rights to immovable property and their encumbrances, the state cadastral registrar, the BTI or any other technical inventory entity, local self-government bodies, executive authorities, tax authorities and any other institutions if needed to perform this power of attorney;
- submit, sign and receive applications, forms, petitions, certificates, opinions, extracts, information certificates, technical documentation, a technical passport, decisions, registration documents and any other documents needed for a loan agreement, a sale and purchase agreement, a mortgage agreement and the state registration of rights in rem;
- receive loan funds from the bank, including for settlement for the purchased property, and transfer funds to the seller or to other persons if this is provided for by the agreements and the bank's requirements;
- set the price, deadlines, payment procedure, security for performance of obligations, conditions of transfer of the property and other essential terms of the agreements, negotiate on my behalf, sign preliminary agreements, deposit agreements, handover and acceptance acts, receipts and other supporting documents;
- enter into and sign the loan agreement, the sale and purchase agreement, the mortgage agreement and any other transaction related to the acquisition of the property and the security of the loan obligations, unless the signing of such documents must be done by me personally under the bank's requirements or by law;
- file documents for assigning a cadastral number to the land plot if the property is located on a land plot or the land plot is transferred together with it, and obtain extracts from the State Land Cadastre and the State Register of Rights to Immovable Property;
- order a valuation of the mortgaged property, technical inventory, a technical passport, BTI certificates, extracts from registers, approvals and other documents needed for the transaction, notarisation and state registration;
- submit statements about marital status and about the fact that the funds used for settlement are not part of the spouses' joint property, as well as any other statements required by the notary, the bank or by law;
- pay notarial charges, administrative fees, bank commissions, taxes, duties, valuation costs, technical inventory costs and other mandatory payments connected with this power of attorney;
- file documents for state registration of ownership of the property, the mortgage and other rights in rem, and receive extracts, decisions, notices, refusals and other documents issued after the applications are considered;
- organise, order and supervise repairs, redevelopment or reconstruction of the acquired property without changing its intended use, and obtain permits, notifications, opinions, technical documentation and new registration documents if required;
- after the acquisition of the property, have free access to it, receive the keys, accept the property under a handover and acceptance act, and take any other actions connected with its transfer and use;
- perform any other acts necessary for the full performance of this power of attorney.
This power of attorney is issued with the right to partially delegate powers to third parties, except for receiving the loan and signing the loan agreement, the sale and purchase agreement and the mortgage agreement, unless otherwise required by law or by the bank. It shall be valid until "___" ____________ 20__ unless revoked by me earlier.
The content of Articles 244-250 of the Civil Code of Ukraine, Articles 60-74 of the Family Code of Ukraine, the Law of Ukraine "On Mortgage" and the requirements of the Tax Code of Ukraine has been explained to me.
