Below is a practical sample of an apartment lifetime maintenance and care agreement. It is suitable for a notary draft, but the parties, title details, maintenance amount, and lifetime residence clause must be filled in for the actual transaction.

If the apartment is jointly owned by spouses or by several co-owners, agree the shares and the required consents before signing. The title deed and the register record should match the current State Register of Rights to Immovable Property and Their Encumbrances.

APARTMENT LIFETIME MAINTENANCE AND CARE AGREEMENT
Kyiv, "__" ____________ 20__

Citizen of Ukraine [Full name of the Alienator], taxpayer registration number (RNOCPP) [number], passport or ID card [details], residing at [address], on the one side, and citizen of Ukraine [Full name of the Acquirer], taxpayer registration number (RNOCPP) [number], passport or ID card [details], residing at [address], on the other side, hereinafter referred to as the Alienator and the Acquirer, have entered into this Agreement as follows:

  1. The Alienator transfers into the ownership of the Acquirer apartment No. __ in building No. __ located at [address], and the Acquirer undertakes to provide the Alienator with lifetime maintenance and, if health is lost, lifetime care.
  2. The Alienator's title to the apartment is confirmed by [title deed and details] or by the current entry in the State Register of Rights to Immovable Property and Their Encumbrances.
  3. The apartment has a total area of __ sq. m and a living area of __ sq. m. Its composition, room count, and other technical data are stated in the technical passport and other current property documents.
  4. The parties value the apartment at UAH __. The stated value is used for notarization and, if necessary, for taxation and other calculations required by law.
  5. The Acquirer shall provide maintenance and care in the following form:
    • monthly payment of at least UAH 200 no later than the 10th day of each month;
    • household assistance, including repairs of clothes and shoes, hairdressing services, wet cleaning of the apartment once a week, laundry and ironing once every 10 days, and minor repairs of household and audio/video equipment and the apartment itself as needed;
    • purchase of medicines prescribed by doctors and payment for treatment;
    • home medical care by general practitioners and specialists, including examinations, procedures, consultations, injections, massage, and similar services;
    • provision of technical and other rehabilitation aids where required by the conclusion of the Medical and Social Expert Commission (MSEC), except for prostheses made of precious metals and except where such aids are provided at public expense by the state program;
    • weekly delivery of food to the Alienator's place of residence;
    • sanatorium and resort treatment not less than once every three years, with payment for travel in a compartment carriage when medically indicated;
    • reimbursement of the cost of a voucher purchased by the Alienator personally, up to UAH 1,500, against supporting documents;
    • daily three-meal nutrition with a total caloric value of 2,000 to 2,500 kcal, according to the daily product norms set out below;
    • providing warm clothing and shoes once every three years, within the value limits stated in the contract sample;
    • annual newspaper subscription, quarterly purchase of theatre tickets up to UAH 50, and other small practical expenses specified by the parties;
    • care for the Alienator's dog, named "Caesar," during the Alienator's absence, with feeding and walking twice a day at the Alienator's expense.

  7. The value of the maintenance provided each month is set by the parties at UAH 700. This value may be indexed in accordance with the law.
  8. The Alienator has the right to demand timely and full performance of the maintenance and care obligations and to demand termination of the Agreement and return of the property if the Acquirer fails to perform or improperly performs those duties.
  9. The Alienator and the Acquirer confirm to the notary that they understand the meaning and legal consequences of this Agreement, are acting voluntarily, are not under coercion, are not legally incapable, and understand the content of the agreement text prepared for them.
  10. The Alienator confirms that the apartment has not been sold, gifted, otherwise alienated, pledged, arrested, subjected to tax lien, or encumbered; there is no court dispute; no third-party rights exist; and the apartment has not been contributed to the charter capital of any legal entity.
  11. If the Acquirer cannot continue performance for substantial reasons, the obligations may be transferred with the Alienator's consent to a family member of the Acquirer or another person who agrees to assume them.
  12. If the Acquirer dies before the Alienator, the obligations pass to the heirs who receive the transferred property. If the Acquirer has no heirs or they refuse the Agreement, the immovable property that was the subject of the Agreement returns to the Alienator.
  13. No set-off of counterclaims is allowed in respect of lifetime maintenance and care.
  14. The Acquirer shall keep a service log listing the specific assistance and expenses. Each entry should be signed by both parties. If the Alienator refuses to sign, an act signed by at least two witnesses should be prepared.
  15. Services may be provided personally by the Acquirer or by third persons at the Acquirer's expense.
  16. All costs related to drafting and notarizing this Agreement are paid by the Acquirer unless the parties agree otherwise.
  17. The Alienator retains the right to lifelong residence in room No. __ measuring __ sq. m, with windows facing [yard/street].
  18. Loss or destruction of the property transferred to the Acquirer is not a ground for terminating or reducing the Acquirer's obligations.
  19. If the apartment is lost or destroyed, the parties may agree to replace it with house No. __ located at [address], and the scope of the Acquirer's obligations remains unchanged.
  20. The Acquirer acquires ownership of the apartment from the moment of state registration of title.
  21. Before the Alienator's death, the Acquirer may not sell, gift, exchange, pledge, or otherwise transfer the apartment to another person.
  22. The parties are familiar with Articles 744-758 of the Civil Code of Ukraine, Articles 57, 59, and 65 of the Family Code of Ukraine, and item 13 of the Rules for the Use of Residential Buildings and Premises approved by Resolution No. 572 of the Cabinet of Ministers of Ukraine of 8 October 1992.
  23. The parties confirm that there are no unanswered questions about the content of this Agreement or the cited legal provisions.
  24. This Agreement may be terminated by a court on the Alienator's claim if the Acquirer fails to perform or improperly performs the obligations, or on the Acquirer's claim. It terminates automatically upon the Alienator's death.
  25. If the Agreement is terminated because the Acquirer failed to perform the duties, the Alienator regains ownership of the property and may demand its return. Expenses borne by the Acquirer for the Alienator's maintenance and care are not refunded.

This Agreement is drawn up in three copies: one remains in the file of the private notary of the Kyiv City Notarial District [Notary name, address], and the other two copies are issued to the parties.

Notary certification and the prohibition of alienation are entered in the usual notarial form after signing.
