Below is a working sample of an apartment sale and purchase agreement used when several sellers own the apartment in shares. It is suitable for notarization if the title has already been registered and the notary has checked each seller's share in the State Register of Rights to Immovable Property and Their Encumbrances.

Before signing, the parties should also check the title documents, the current list of registered persons in the apartment, and any rights of use. If one seller's share is joint marital property, the spouse's consent is drawn up as a separate notarized statement and attached to the notarial file.

The template below leaves placeholders for the parties' details, the size of each share, the price, the payment method, and the notary's details. Tax consequences and mandatory charges are determined under the law in force on the date of notarization.

  1. Under this Agreement, the Sellers, as co-owners of the apartment in shared ownership, transfer title to the Buyer, and the Buyer accepts the apartment and pays the agreed price.
  2. Each Seller's title to the share being sold is confirmed by [title deed name and details]. The information about the shares, title, and encumbrances is checked in the State Register of Rights to Immovable Property and Their Encumbrances on the date of notarization.
  3. The apartment has a total area of __ sq. m, living area of __ sq. m, consists of __ rooms, and is identified according to the title and technical documents. If the technical data has changed, the current documents are used.
  4. The sale price of the apartment is UAH __. Payment is made by bank transfer or another lawful method agreed by the Parties on the day of notarization or within another period agreed by the Parties, if this does not contradict the law.
  5. The Sellers confirm that the apartment has not been sold to anyone else, gifted, or otherwise disposed of, is not under arrest, mortgage, pledge, tax lien, or other encumbrance, is not the subject of any court dispute, and no third-party rights are established. The information provided for notarization is true.
  6. If any Seller's share is joint marital property, this Agreement is accompanied by the notarized consent of the other spouse. If a Seller owns the share as personal private property, such consent is not required.
  7. Expenses related to notarization, state registration of ownership, and other mandatory charges are paid in accordance with the law and the Parties' agreement. If the Buyer must pay the mandatory state pension insurance fee or any other mandatory payment, it is paid in the manner established by law.
  8. The Buyer's ownership of the apartment arises from the moment the ownership right is registered after notarization of this Agreement.
  9. The Buyer confirms that they have inspected the apartment, reviewed the title and technical documents, and checked the list of registered persons and any rights of use before signing this Agreement.
  10. The Parties confirm that the tax consequences, mandatory fees, and other payments related to this transaction are determined according to the current legislation of Ukraine on the date of notarization.
  11. The Parties are familiar with Articles 182, 334, 358, 655, 657, and 659 of the Civil Code of Ukraine, Article 65 of the Family Code of Ukraine, and the Law of Ukraine "On State Registration of Rights to Immovable Property and Their Encumbrances".
  12. The content of this Agreement is clear to the Parties, and there are no unanswered questions.
  13. This Agreement is executed in three originals of equal legal force: one is kept in the notary's file, one is given to the Buyer, and one is given to the Sellers.
